A New Era in Real Estate

The Real Estate industry is experiencing a significant transformation, due to a recent settlement between the Department of Justice (DOJ) and the National Association of Realtors, along with several major brokerage firms. Central to the DOJ’s case was the concern that home Buyers using a Real Estate Agent to purchase a property, may not have been fully aware that the Seller was cover- ing their Agent’s commission. This long-standing arrange- ment prevented Buyers from having the opportunity to negotiate the Buyer’s Agent’s fee. Now, a business model that has been in place for over a century—where Sellers traditionally paid the Buyer’s Agent—has become fully transparent to Buyers.

New Era in Real Estate

While this change is expected to influence how commis- sions are handled, it remains clear that Buyers will con- tinue to require representation. However, what remains uncertain is whether Buyers will experience significant savings. If Buyers are required to pay their Real Estate Agent directly, it could increase the upfront costs associ- ated with purchasing a home. Consequently, many Sellers may still prefer to cover the cost of a Buyer’s Agent to attract a broader pool of potential Buyers. Since representation fees are typically not factored into a home’s valuation,

there is skepticism regarding whether Sellers will lower their asking prices if they are no longer responsible for the Buyer’s Agent’s commission. The future of Real Estate is likely to involve more negotiations between Buyers, Sellers, and Agents, making it more important than ever to work with a skilled Agent.

Another notable change, effective August 17, is the requirement for Buyers to sign a Buyer-Broker contract before viewing a property. This new step creates a committed relationship which will likely prompt Buyers to choose an experienced Agent, with proven negotiating skills, to help them with the purchase. Buyers will still be able to walk into an open house without a Buyer-Broker agreement. A signed Buyer-Broker agreement is definitely required when a Buyer comes to see a home with an appointment.
